We are committed to maintaining your data as accurately as possible and to collect data for a specified, explicit, and legitimate reason. The data should be limited to what is necessary for us to interact with you in an appropriate business context.  The nature of that data varies for the different products and websites.  Specific details are in the relevant sections below.

WHERE ARE DATA STORED?

For our Product Websites, the data are stored in the UK. For the Marketing Website, the data are stored either in the UK, the EEA, a country that the European Commission has determined providers an adequate level of protection, or by service providers who are certified under the Privacy Shield.

We shall not transfer your data outside these countries or providers without your permission.

SPECIAL CATEGORY DATA

We do not store Special Category data, as defined under Article 9 in the EU General Data Protection Regulation 2016 (GDPR).

WITH WHOM DO WE SHARE YOUR DATA?

We share the data with third party service providers to help manage our business and deliver services. For example, we have service providers who provide IT applications or systems, which means that your personal data will be hosted on their servers, but under our control and direction.  We require all our service providers to respect the confidentiality and security of personal data.

YOUR RIGHTS

Our feedback products store feedback that users have given about each other.  Where the nature of the feedback product is such that this feedback is open, such as appraisal feedback, then all such data are accessible.  However, where the process has been designed on the understanding that the feedback is anonymous and aggregated, such as confidential 360 feedback, then we reserve the right to withhold access on the grounds that it would ‘adversely affect the rights and freedoms of others’.

Correction of personal data: You can request that we rectify and correct any personal data that we are processing about you which is incorrect.

Right to withdraw consent: Where we have relied upon your consent to process your personal data, you have the right to withdraw that consent.

Right to erasure: You can request us to erase your personal data where there is no compelling reason to continue processing. This right only applies in certain circumstances, it is not a guaranteed or absolute right.

Right to data portability: This right allows you to obtain the personal data that you have provided to us with your consent or which was necessary for us to provide you with our products and services in a format which enables you to transfer that personal data to another organisation.

Right to restrict processing of personal data: You have the right in certain circumstances to request that we suspend our processing of your personal data. Where we suspend our processing of your personal data we will still be permitted to store your personal data, but any other processing of this information will require your consent, subject to certain exemptions.

Right to object to processing of personal data: You have the right to object to our use of your personal data which is processed on the basis of our legitimate interests. However, we may continue to process your personal data, despite your objection, where there are compelling legitimate grounds to do so or we need to process your personal data in connection with any legal claims.

Rights relating to automated decision making and profiling: You have the right not to be subject to a decision which is based solely on automated processing (without human involvement) where that decision produces a legal effect or otherwise significantly affects you. This right means you can request that we involve one of our employees or representatives in the decision-making process. We do not make automated decisions of this nature.

Talent Innovations Limited uses the principle of ‘Legitimate Interest’ as the basis for collecting and processing personal data for the purposes of marketing our products and services to existing and potential business clients. In rare circumstances, we shall collect data for individuals and sole-traders.  In these cases, we use the principle of ‘Consent’ as the lawful basis for collecting and processing data.

DATA THAT WE COLLECT

You may give us information about you by filling in forms on the marketing website or by corresponding with us by phone, email, or otherwise. These data include, but is not limited to contact information such as, name, email address, organisation, and telephone number.

If you have consented (opted-in) to receive communications from us, you may withdraw your consent at any time by emailing info@talentinnovations.co.uk with your request.

We use your data in the following ways:

For the purposes of GDPR, Talent Innovations is the Data Processor for these products. The Data Controller is the Client for whom we are processing the data.  In most cases, this will be the HR team of the Client.  We will supply the contact details of your Data Controller upon request by emailing info@talentinnovations.co.uk.

Our product websites are used for processing data about individuals for the purpose of delivering contracted feedback programs.

Talent Innovations Limited uses the principal of ‘Contract’ as the basis for collecting and processing personal data.

DATA THAT WE COLLECT

Name and contact data: We collect your name and email address so that we can contact you.

Credentials: We collect (encrypted) passwords for authentication and account access.

Demographic data: We collect data about your gender, country, and preferred language for personalising communications.

Company data: Some Data Controllers require additional company data for the purpose of aggregating their version of the feedback product, and so we may also collect data such as job title, grade, department, company, location. We also collect relationship data, such as managers, peers, reports, and team members.

Feedback data: We collect the feedback data that you supply. This includes your ratings, comments, and opinions about yourself and others. It may also include personal and organisational objectives and goals.

Device and usage data: We collect data about how you and your device interact with our products. For example, we collect:

–  Device and connectivity data: We collect data about your device, the web browser that you use to connect to our website, your operating system, and your IP address.

–  Access data: We collect data about the pages and features that you access.

–  Error and performance data: We collect data about the performance of the products and any problems that you experience with them. These data help us to diagnose problems in the products that you use, and to improve our products and to provide solutions.

Data is retained for three years from the end of the contract, unless the Data Controller specifically requests an alternative retention period.

Google Analytics: Our Marketing Website uses Google Analytics to help analyse how visitors use it and gauge their experience. Once collected this information is then processed and used to compile statistical reports used and seen by Talent Innovations employees only. We will then use that data to access how visitors find the experience of visiting our site, implementing changes to enhance your experience and that of future visitors. We use cookie technology to customise content and advertising, to provide social media features and to analyse traffic to the site. We also share information about your use of our site with our trusted social media, advertising and analytics partners. The purpose of collecting your IP address is solely to determine the geographic region for these statistical reports. At no point will any of the Talent Innovations team try to identify or associate this data with any personally identifiable information about you unless you have explicitly passed this information to us by filling in one of our forms that are present on our website.
